ေမး။ ။ မည္သို႕ေသာအလုပ္သမားသည္ မေလးရွားအလုပ္သမားဥပေဒပါ အခြင့္အေရးမ်ားကုိ ခံစားခြင့္ ရွိသနည္း။
ေျဖ။ ။ လစာေငြရင္းဂစ္ ၁၅၀၀ေအာက္ ၀င္ေငြရွိေသာ အလုပ္သမားအားလံုးခံစားခြင့္ရွိသည္။ အေထြေထြ အလုပ္သမားမ်ားအတြက္မူ လစဥ္၀င္ေငြဘယ္ေလာက္ပပ္ျဖစ္ေစ အႀကံဳး၀င္သည္။ အလုပ္ရွင္ႏွင့္ စာခ်ဳပ္ခ်ဳပ္ဆို၍ လုပ္ကုိင္ေနေသာ အလုပ္သမားမ်ားလည္း အႀကံဳး၀င္သည္။

ေျဖ။ ။ လုပ္ငန္းသေဘာတူစာခ်ဳပ္ဆိုသည္မွာ လူတဦးသည္ အျခားလူတဦးထံ၌ အလုပ္သမားအျဖစ္ အလုပ္လုပ္ကုိင္ျခင္းကုိ ဆိုလိုပါသည္။ လုပ္ငန္းသေဘာတူစာခ်ဳပ္တြင္ ႏႈတ္အားျဖင့္လည္းေကာင္း၊ စာအားျဖင့္လည္းေကာင္း ၂မ်ဳိး ရွိႏိုင္ပါသည္။ အလုပ္သမားအေနျဖင့္ လုပ္ငန္းသေဘာတူစာခ်ဳပ္ မိတၱဴ တေစာင္ကုိ သိမ္းဆည္းထားခြင့္ရွိသည္။

ေျဖ။ ။ အလုပ္သမားတုိ႕၏ ရပိုင္ခြင့္အားလံုးပါ၀င္ပါသည္။ ဆိုလိုသည္မွာပံုမွန္အလုပ္ခ်ိန္ သတ္မွတ္ခ်က္၊ အခ်ိန္ပိုအလုပ္ႏွင့္ လုပ္အားခေပးေခ်မႈ၊ လုပ္သက္ခြင့္၊ အမ်ားျပည္သူအားလပ္ရက္ခြင့္၊ က်န္းမာေရးခြင့္၊ လစာေငြ စသည္တို႔ ျဖစ္ၾကပါသည္။ ထို႕ျပင္ အလုပ္ရွင္အေနျဖင့္ အလုပ္သမားထံမွ လစာေငြျဖတ္ေတာက္ျခင္းကုိ ဥပေဒေဘာင္ အတြင္းမွသာ ျဖတ္ေတာက္ခြင့္ရွိသည္။ အမ်ဳိးသမီးမ်ား အေနျဖင့္ မီၤးဖြားခြင့္ကို ခံစားခြင့္ ရွိသည္။

ေမး။ ။ အကယ္၍ အလုပ္သမားတဦးသည္ အလုပ္ရွင္ႏွင့္ စာခ်ဳပ္ခ်ဳပ္ဆို၍ လုပ္ကုိင္ခဲ့ေသာ္ ၎အေနျဖင့္ ၁၉၅၅ အလုပ္သမားဥပေဒႏွင့္ အႀကံဳး၀င္ပါသလား။
ေျဖ။ ။ ဟုတ္ကဲ့ အႀကံဳး၀င္ပါသည္။ စာခ်ဳပ္တြင္ မည္သုိ႕ေသာ အခြင့္အေရးမ်ားပါသည္ကုိ ေသခ်ာစြာ ၾကည့္႐ႈပါ။ အလုပ္သမား ဥပေဒသည္ ေကာင္းမြန္ေသာ္လည္း ထိုအခြင့္အေရးမ်ား သင္၏စာခ်ဳပ္တြင္ ပါ၀င္ျခင္းရွိမရွိ စစ္ေဆးပါ။ မပါရွိခဲ့ေသာ္ ျဖည့္စြက္ေရးသားရန္ ေတာင္းဆိုပိုင္ခြင့္ရွိသည္။

၂။ ၅နာရီဆက္တိုက္ အလုပ္လုပ္ခဲ့ရေသာ္ မိနစ္ ၃၀ထက္မနည္းေသာ နားခ်ိန္ကုိ ရရွိရမည္။
၃။ တပတ္တြင္ ၄၈နာရီ ပံုမွန္အလုပ္ခ်ိန္ရွိသည္။ အျပန္အလွန္ ခ်ဳပ္ဆိုထားေသာ စာခ်ဳပ္တြင္ တေန႕အလုပ္ခ်ိန္ ၉နာရီခ်ဳပ္ဆိုႏိုင္ေသာ္လည္း တပတ္တြင္ ၄၈နာရီထက္ မပိုရပါ။

ေမး။ ။ ဥပေဒႏွင့္အညီ လစာေငြ ျဖတ္ေတာက္ျခင္းဆိုသည္မွာ ဘာကို ဆုိလိုပါသနည္း။
ေျဖ။ ။ ၎တို႕မွာ ဥပေဒအရ ခြင့္ျပဳထားေသာ အလုပ္သမားဖူလံုေရး ရန္ပံုေငြႏွင့္ အသက္အာမခံေၾကး ေပးေဆာင္ရန္အတြက္ ျဖတ္ေတာက္ျခင္းကို ဆိုလိုပါသည္။ အလုပ္သမားဥပေဒတြင္ လြန္ခဲ့ေသာ ၃လက အေၾကာင္းတစံုတရာေၾကာင့္အလုပ္ရွင္ထံမွ ေခ်းယူထားေသာ ေငြအား ျဖတ္ေတာက္ခြင့္ ျပဳထားပါသည္။ သို႕ေသာ္လည္း ၁လလုပ္အားခထက္ပိုေသာ ေငြေၾကး ျဖတ္ေတာက္ျခင္းကုိ ခြင့္မျပဳပါ။

ေျဖ။ ။ အလုပ္သမားအေနျဖင့္ ၁ပတ္တြင္ ၁ရက္ အားလပ္ရက္ ခံစားခြင့္ရွိသည္။

ေမး။ ။ အလုပ္ရွင္သည္ လုပ္ငန္းလိုအပ္ခ်က္ေၾကာင့္ အလုပ္သမားကုိ အားလပ္ရက္တြင္ အလုပ္လုပ္ကုိင္ရန္ ခြင့္ျပဳပါသလား။

ေျဖ။ ။ အလုပ္သမားအေနျဖင့္ မလိုက္နာေသာေၾကာင့္ လုပ္ငန္း သေဘာတူစာခ်ဳပ္ ပ်က္ျပယ္ႏိုင္ပါသည္။ အဘယ္ေၾကာင့္ဆိုေသာ္ အလုပ္သမားမ်ားအေနျဖင့္ သာမန္အလုပ္လုပ္ရက္တြင္ ၂ရက္ဆက္တိုက္ ခြင့္မဲ့ပ်က္ကြက္ခဲ့ျခင္းေၾကာင့္ျဖစ္သည္။ သို႕ေသာ္ အလုပ္သမားအေနျဖင့္ ပ်က္ကြက္ခဲ့ေသာ ခြင့္ရက္အတြင္း အလုပ္ရွင္ထံ အက်ဳိးသင့္အေၾကာင္းသင့္ ရွင္းျပႏိုင္ေသာ အခြင့္အေရး ရွိသည္။

LEPTOSPIROSIS CAUSES DEATH OF ANOTHER 6 BURMESE IN DETENTION IN MALAYSIA
DENIAL OF HEALTHCARE IS A VIOLATION OF RIGHT TO LIFE

We are shocked and disappointed to hear that another six Burmese migrants have died while in detention in Malaysia because of a suspected waterborne disease. Leptospirosis is caused by exposure to water contaminated by animal urine, like rat urine. (Straits Times, 25/9/2009, Migrants die in detention/ Associated Press, 24/9/2009).

From our investigation, the names of 3 of those who have died are So Thein [Prison Body number 0853, Block B1, Ethnicity: Burman, Age: 36], Min Khaing [Body number 5009, Ethnicity: Karen, Age: 23] and Min Nown [Ethnicity: Arkan, Age: 28]. The other 3 are of Chin ethnicity. It seems that the deaths happened in August.

This time the deaths seem to have occurred at the Detention Centre at the KL International Airport (KLIA) depot. The Straits Times report states that an official had informed them that ‘…the detainees likely contracted the disease in another centre. They were transferred together with some 700 others after a riot there...’. In an earlier report (Star, 24/7/2009), it was stated that ‘…some 700 Myanmar illegal immigrants involved in a ruckus at the Semenyih immigration depot early this month have been moved to the department’s KL International Airport (KLIA) depot…’

It must be noted that this is not the first case of death by reason of Leptospirosis. Sa La Hin, 26, and Thang Hoih Ping, 21, two Burmese migrants, died in the Malaysia’s Juru Immigration Detention Centre from Leptospirosis in May 2009. 127 civil society groups and organizations responded vide a joint statement entitled ‘Death Of 2 Burmese Indicative Of State Of Detention Places In Malaysia - Denial Of Healthcare Is A Violation Of Right To Life’.

Complaints were also lodged with the Malaysia’s Human Rights Commission (SUHAKAM), Malaysian Prime Minister Dato' Sri Mohd Najib Bin Tun Haji Abdul Razak,, Minister of Home Affairs Datuk Seri Hishammuddin Tun Hussein, and the Minister of Health Dato' Sri Liow Tiong Lai,

After that Leptospirosis outbreak in the Juru Detention Centre in Penang in May, the Immigration Director-General Abdul Rahman assured us that the cleanliness and hygiene at immigration depots nationwide will be stepped-up to ensure safety of staff and inmates there against contracting infectious diseases (Bernama, 19/5/2009).

SUHAKAM also vide letter dated 16/7/2009 had informed us that they had met with the Director General of Immigration on 4/6/2009, and amongst others, had recommended that ‘… as a measure to control contagious diseases to ensure that all immigration detention centres should have a doctor or medical officer in line with international requirements, and that cleanliness of detention centres should be taken care of.’

It must also be borne in mind that last year SUHAKAM identified medical care as an overriding reason why 1,300 detainees have died over the past six years, and had made recommendations to the government. At present the 22 centres throughout Malaysia do not have a permanent clinical dispensary manned by doctors or a medical assistant to help detainees. (ABC News, 28/5/2009)

In May 2009, it was reported that about 26 were admitted to hospital following a Leptospirosis outbreak in the Juru Detention Centre, and they survived, and this leads us to believe that prompt access to healthcare can avoid death. It is shocking that in this recent case, 6 have died. What is more disturbing is that there seem to have been no reported disclosure by the Malaysian authorities on this. We still do not know the number of detainees that have been affected this time.

This is a disease caused by exposure to water contaminated with the urine of infected animals, and is very rarely propagated through contact with affected persons. Question must be raised as to how detainees in an enclosed detention centre are contracting this disease. Are they being affected through the food and water supplied by the detention centres? Are the detention centres having a rat infestation problem?

After the recent deaths and outbreak in the Juru Detention Centre, one would have expected the Malaysian government to have taken immediate steps to ensure that there are no more cases of Leptospirosis outbreak and deaths. We wonder also whether the authorities took a lackadaisical attitude, and did not even conduct a thorough investigation to determine the source of the contamination that caused that outbreak. Results of such investigations will not only determine liability, but would also ensure that further deaths from Leptospirosis could be avoided.

We, the undersigned, call on the Malaysian Human Rights Commission (SUHAKAM) to immediately commence a public inquiry into these deaths and detention places generally, and come up with concrete recommendations which could be implemented that will improve state of cleanliness, hygiene and healthcare of all detention places in Malaysia. It was sad that SUHAKAM decided not to carry out a public inquiry after the Juru deaths in May.

We are also call upon the Ministry of Health and the government of Malaysia to conduct a thorough investigation into the cause of this Leptospirosis outbreak, which is reported to have already resulted in 6 deaths.

We also call for the resignation of Immigration Director-General Abdul Rahman, considering that this is second reported case of deaths by reason of Leptospirosis at Immigration Detention Centres within the last 4 months.

The Malaysian government must take necessary action to ensure that proper steps be taken so that such disregard for life does not happen again.

With regard to those who have died, their family and/or dependents should be given adequate compensation by the persons responsible, the detaining authority and the Malaysian government.

Officers and persons responsible for the acts or omissions that resulted in death and suffering should be charged and prosecuted for these crimes. They should not be permitted to hide behind safeguards provided to public servants, which unfortunately only promotes culture of impunity with no sense of responsibility and respect for human life.

We would like to inform you about two legal Burmese migrant workers who died at work in bayan lepas, pulau pinang on 30th May, 2009. The dead bodies of two workers have been kept in hospital Dato keramat Timur laut, George Town. When they died, they were working at project 112b-5 Jln permatang damar laut,Taman gembira, 11900 bayan lepas, pulau pinang . Their names are San Maung (passport no: A014430) and Saw Htay( passprot no: 890515). Their work permit will be expired on 8th October, 2009. They were working at E T construction Sdn Bhd, No. 1.v, jln berika 2, Bdr baru air itam, ayer itam, 11500 pulau pinang. The employer failed to follow the Malaysia employment Act 1955. The employer wants to do the funeral of two workers quietly and hasn't paid any compensation yet for two dead workers.
Therefore, we have already informed the Pinang Labour Department on 3rd June, 2009 regarding this case The labour department is investigating the case of two dead workers.

We would like to request you to urge the employer to follow the current existing Malaysia labour law and pay the compensation to the families of two dead workers as soon as possible.

DEATH OF 2 BURMESE INDICATIVE OF STATE OF DETENTION PLACES IN MALAYSIA

DENIAL OF HEALTHCARE IS A VIOLATION OF RIGHT TO LIFE

We, the undersigned, are alarmed to hear that Sa La Hin, 26, and Thang Hoih Ping, 21, two Burmese migrants, have died in the Malaysia’s Juru Immigration Detention Centre from Leptospirosis. This is disease that is usually caused by exposure to water contaminated with the urine of infected animals, such as rodents, cattle, pigs, horses, dogs and wild animals. The fact, that 2 persons are dead and others have been infected by this disease, again highlights the state of hygiene, cleanliness and healthcare at Malaysian Detention Centres.

We recall that it was reported in the media in December 2008, that "About 1,300 illegal foreigners have died during detention in the past six years, Malaysia Nanban quoted Malaysian Human Rights (Suhakam) commissioner Datuk N. Siva Subramaniam as saying. He said many of them died in immigration detention centres, prisons and police lockups because they were denied medical treatment at the right time.” [Star, 18/12/2008, ‘1,300 foreign detainees died due to neglect’]. Now, Sa La Hin and Thang Hoih Ping may just be the latest additions to that list of detainees that died due to similar reasons.

We also recall the words of SUHAKAM in their response to the Asian Human Rights Commission (AHRC) dated 13/1/2009, that correctly stated that ‘…SUHAKAM views the denial of medical attention to the point of endangering one’s life as a serious violation of that person’s right to life….’

These deaths may have been avoided if medical attention was provided promptly, and we call for an independent public inquiry to determine whether there was such negligence on the part of the Ikatan Relawan Rakyat or better known as RELA (a People's Volunteer Corps), and the Immigration officers, who are currently responsible for Immigration Detention Centres in Malaysia.

We do appreciate the fact that the Director General of Immigration has now decided that ‘cleanliness and hygiene at immigration depots nationwide are to be stepped-up to ensure safety of staff and inmates there against contracting infectious diseases’ (Bernama, 19/5/2009, Cleanliness, Hygiene at Immigration Depot to Be Stepped Up).

We hope that this is not merely a knee-jerk response, which is temporary in nature, but a new and permanent commitment by Malaysia to improve standards and conditions of Detention Centres and other places of detention.

The current once a week visit by a medical officer to the Detention Centres is certainly inadequate. There should be, at the very least, a permanent clinic/dispensary manned by a medical assistant, with a doctor visiting detainees for several hours at least once every two days or more frequently.

New users of the Detention facility should also be determined free from easily transmittable diseases like Tuberculosis and the A(H1N1) flu before being introduced to the general population of detention places.

There should also be regular visits by the Health Officer, who shall monitor the conditions, including of the living and sleeping environment, of the Detention Centre to ensure that it meets the highest standards of hygiene and cleanliness.

The foods, and all aspects of food preparation, also need to be monitored by the Health Department especially since there is a possibility that the fault in the recent deaths could be the current caterer of food and drink.

With regard to those who have died, we are of the opinion that their family and/or dependents should be given adequate compensation by the persons responsible, the detaining authority and the Malaysian government.

Officers and persons responsible for the acts or omissions that resulted in death and suffering should be charged and prosecuted for these crimes. They should not be permitted to hide behind safeguards provided to public servants and/or the RELA volunteers, which unfortunately only promotes culture of impunity with no sense of responsibility and respect for human life.

We, the undersigned, call on the Malaysian Human Rights Commission (SUHAKAM) to immediately commence a public inquiry into these deaths and detention places generally, and come up with concrete recommendations which could be implemented that will improve state of cleanliness, hygiene and healthcare of all detention places in Malaysia.

We are also call upon the Ministry of Health and the government of Malaysia to take necessary steps to ensure that proper steps be taken to ensure that such disregard for life does not happen again.

We reiterate the call for the abolition of RELA, and restate our position that law enforcement, and management of detention places should be done by professionally trained full-time public servants, not volunteers.

WITHDRAW ABSURD CHARGES AGAINST AUNG SAN SUU KYI
RELEASE IMMEDIATELY AND UNCONDITIONALLY ALL POLITICAL PRISONERS IN BURMA

We, the undersigned, are shocked that Aung San Suu Kyi has now been absurdly charged for the offence of breaking the terms of her house arrest, in particular the condition that forbids visitors, after an American man, swam across the lake and entered her house uninvited and refused to leave.

Daw Aung San Suu Kyi and her two assistants were reported to have been charged on 14/5/2009 with breach of detention under Section 22 of the Law Safeguarding the State from the Dangers of Subversive Elements, and their trial is scheduled to begin on Monday (18/5/2009) in an Insein Prison special court set up to handle political dissidents.

American, John William Yettaw, 53, of Falcon, Missouri swam across Inya Lake on the night of May 3 and left the compound early on the night of May 5, swimming a distance of about 2 kilometers. Authorities arrested him later that morning.

In Burma , it is also against the law for a foreigner to stay in the home of a Burmese citizen overnight without approval from authorities.

Dr. Tin Myo Win, Suu Kyi’s family physician, also will allegedly be charged in connection with Yettaw’s staying in Suu Kyi’s compound overnight. Yettaw himself is also expected to be charged, presumably for violating one of Burma ’s internal security laws.

Aung San Suu Kyi and her two assistants, have been taken from her home and is currently being detained in the infamous Insein Prison since 14/5/2009.

Daw Aung San Suu Kyi, 63, the leader of the National League for Democracy(NLD), has spent 13 of the past 19 years in virtual isolation in her home since the Burmese military junta refused to recognise NLD's landslide victory in the country's last elections in 1990.

The most recent, six-year period of detention is due to end on May 27. The junta’s justification for keeping her locked away under the provisions of this draconian 1975 national security law was to protect the state from "destructive elements". Many speculate that this recent incident was created or being manipulated to discredit Suu Kyi and provide justification for the military government to extend her house arrest again.

We call for the immediate withdrawal of this absurd charge levied against Aung San Suu Kyi, and her 2 assistants;

We also call for the immediate and unconditional release of Aung San Suu Kyi and all other political prisoners and prisoners of conscience in Burma ;
We call for ASEAN and ASEAN member governments, including Malaysia, to immediately intervene and urge the government of Burma to respect human rights, and to adhere to the numerous United Nations resolutions, including General Assembly Resolution 49/197 [1995], which, amongst others, “…call on the Government of Myanmar to release unconditionally and immediately the Nobel Peace Prize Laureate Aung San Suu Kyi, who is now in her sixth year of detention without trial, and other political leaders and remaining political prisoners…’

We also call on the United Nations(UN), the European Union(EU) and all concerned nations to act for the immediate withdrawal of this absurd charge, to secure the immediate and unconditional release of all political detainees and to restore democracy and human rights to Burma and its peoples.

The factory of UNIBASE SDN BHD is based in Gelang Patah town ship, Johor state. The company is based in Sukudai, Johor. The Nepalese, Bangladeshis, Indonesian and Burmese migrant workers are working in that factory. The factory product is trowel ling works for segment, segment ready, segment casting process etc. the company originally contracted to pay Burmese workers daily wage but the really payment on a piece rate basis. But the workers are not receiving the full rate per piece. Deductions are made before they receive their specified pay per piece. They have to work from 8 am to 10 pm every day. Workers can not get medical leave when they are sick. If they have an accident at the work place, they don’t receive proper treatment. If workers make mistakes, they receive deductions from their salary. The company is not using their pay slips.

The workers built their huts by them self and stay there. The company deducted RM 600 since they arrived at the factory on September 2008 until December 2008. The workers discussed their problem with their section leader Mr. Samsudin, regarding the injustice of wages and other rights but there was no action. On 7 April 2009, the section leader suspended 9 Burmese workers.

The workers contacted to the labour department of BCM to help them with their problem. On 16 April 2009, BCM (Ko Harun) went to Johor for detail about their situation. The next day, 9 Burmese workers and Ko Harun went to the labour office which is under the human resource ministry and the workers reported to labour Officer Nur Afeza Binti Jaafar the abuses and unlawful deductions. The labour office said they would investigate their problem. After that, someone rang Ko Harun hand phone and threatened him and hand up. In the evening, the company management contacted Ko Harun and asked about the workers demands and negotiations. We attach the entire workers name, passport numbers and signatures.

Local Basic SDN BHD (355228-D) is based in Nusajaya Township, Johor state. Nepalese, Bangladeshis, Indonesians, Vietnamese, Philippines, Sri Lankan and Burmese migrant workers are working in this factory. The factory is doing Machining, surface finishing and assembly of fabricated metal products. The factory is working under ISO 9001 QMS and ISO 14001 EMS but the authorities have not provided working equipment such as safety shoes, safety glasses, gloves, ear muffs etc. If the workers don’t use, they safety equipment, factory management will fine them. The fine is various styles. If the workers make mistakes the supervisors or line leaders will beat, slap, kick or push the workers. The workers find it very difficult to get medical leave. So they work even when they are sick. The workers are working overtime more than 120 hours per month. These are not normal hours and do not include rest days. Most of the workers are not skilled so their work is difficult and dangerous.

The living conditions are poor because up to 35 people are sharing a room 10x25 square feet in size. Thus, the rooms are over crowded and unhygienic. Water and electricity are paid for by workers. All of the workers must eat at the factory canteen. The authorities do not allow other food. If they don’t obey, they will be fined RM 50. The workers started to complain about the working conditions and turn to the labour department of Burma campaign Malaysia. BCM explained the worker right in Malaysia and also help them to write down their demands. The workers reported to Galang Patah police station, asking them to investigate about the abuses and violations of labour rights.

On 13th March 2009, 10 am, the factory operation manager Mr. Simon Wong and Human resource manager Mr. Foong Kok Leong arrived at the police station to discuss the police report. The factory has over 100 Burmese workers. All of them are not company work permit workers. Some of the workers have been recruited from Ever Green Reliance SDN BHD. During this economic recession, the factory doesn’t have so many orders so 25 workers have been sent back to Ever Green Reliance SDN BHD. Therefore workers can not report to the labour office of human resource ministry for their demands.

But the human resource manager Mr. Foong promised the labour department of BCM and the police that they will not abuse their workers and will follow the current Malaysia labour law in future. I myself Tun Tun and Ko Latt went to TENAGANTIA NGO office at 9:30 in the morning and asking for some suggestions for the workers. Ms. Pusenthi P. Manaim , the programme officer replied us that everyone in their office was busy with its annual report. At that moment, they were not able to accept any new case until January 2009, they explained.

Therefore, myself and Ko Latt contacted Mr. Tian Chua for some help. Mr. Tian Chua suggested us to contact Mr. Din from Labour Resource Centre (LRC). Afterwards, at 3 pm, we visited LRC bringing three Burmese and three Nepalese migrant workers from Johor state together with us. After one hour discussing with Mr. Din regarding the problem between employees and employers, Mr. Din informed Mr. Syed Shahir, President of MTCU. Then Mr. Syed Shahir contacted and requested Mr. Mohan, Chief of MTCU from Johor state to provide necessary assistance for the migrant workers.

Then, the officer from Johor state labour department told us that on 16th December 2008, Mr. Subra Maniam, Minister of Human Resource Ministry had a schedule to meet with the employer who had problems with our fellow workers. The aim of the meeting was to discuss about Malaysian workers who losing their worker rights, he explained. However, the labour officer said in that meeting, he wasn't sure whether they will discuss about foreign migrant workers' issue. But, the labour told us that if the workers' representatives provide him with necessary information, he will pass that information to the Minister during the meeting.

At the moment, all workers are anxiously waiting for the outcome from that meeting. At the same time, the employer has stopped the workers to use their bank accounts. Previously, workers' wages were normally channeled through their bank accounts. The reason is that we have been informed that the employer was planning to buy the air tickets to send the workers back to their origin of country by using those workers' money. In reality, the employer has to pay for the air tickets from his money for the workers' return. We have heard that it was already arranged to send 40 Burmese migrant workers back to Burma on 16th December 2008 at 8 pm.

16th December 2008

Two Burmese and two Nepalese worker representatives went to the labour department in Johor Baruh and tried to inform Mr. Mohan the cases of migrant workers. Mr. Mohan told them to wait and they waited for quiet long time. Finally, the worker representatives tried directly to meet with the minister of Human Resource Ministry. Then, Mr. Abidin Olhman accepted them for a brief meeting and told them that labour officers will come to their factory and settle the problems between employer and employees. At 1 pm, all of the worker representatives went back to their factory.

While the worker representatives were in human resource office, the office manager took their photos as record and said that he has to send the photos to the police. It caused the worker representatives getting worry and they had to hide away from the factory for a short period. About 3 pm, the officers from labour office arrived at the factory and told the workers that workers' demands will not be met due to the global economic downturn. And for those workers whose work-permits are expired will be sent back to their origin of country, the officers said. Therefore, the officers told the workers to work regularly and save the money to buy the air tickets. After that the labour officers said they will continue to discuss everything details with three worker representatives on 17th December 2008.

At 8 pm, when night shift workers went into the factory, the factory manager told them that for those who didn't work on previous day didn't need to work again and workers went sent back to their hostel. At 11 pm, buses were ready to take those 40 workers to the airport. Some of those 40 workers have to receive their wages from previous working days, but they weren't paid.

Concerning this issue, Burma Campaign Malaysia (BCM) informed Mr. Din in detail. Mr. Din told us he will continue to inform Mr. Abdullah Sani, Member of Parliament from Kuala Langat constituency to be able to take necessary action.

Conflict between employees and employers

In Malaysia, there are more than 500 migrant workers who are currently working in INNO VALUES PRECISION SDN BHD (Co. Reg No. 454311-D) at Pasir Gudang in Johor State.
These workers are mainly from Burma, Nepal and Vietnam. Many Malaysian workers are also working there. This company is a Singapore registered one and it has branch factories in China, Malaysia, Thailand and South Korea.

Majority of foreign workers have the right to work eight hours a day and one day day-off a week. The daily wages of the workers is 18.50 RM. The workers earn between 750 and 850 RM a month including working for extra working time. However, the salary of the workers is not increased, but some have been given just allowance. But the workers enjoy this allowance for only short period of time such as two or three months. On 22nd August 2007, the Burmese worker named Mr. Tin Lin (passport no. 880009) had to cut his thumb shortly after he had the accident in the factory. In that case, the factory authorities did not pay any compensation to him. Besides, according to the regulation of the factory, if a worker is absent to work for a day, he or she will be barred to work for a week. When the workers are sick, the clinic of the factory gives the workers the medical treatment, however the workers have no right to have their health benefit.

At the moment, global economic crisis is affecting every part of the world economy. As a result, many factories have to reduce its work-force. However, the authorities of this company did not follow the existing labour law of Malaysia while reducing the number of the workers. Instead, that company authorities are putting pressure on the workers to quit the jobs.

At the same time, the manager of human resource department of this factory has been treating the workers in inappropriate manner. Therefore, some workers have informed the local police station on that issue.

Currently, the workers from this factory have demanded factory authorities the following points:

1. To remove the manager of human resource department to other factory located in abroad.
2. Due to the lacking of extra working hours in this month, to stop collecting monthly levy fund. 3. To resume 4 hour extra working time a day for the workers.
4. To provide night shift allowance for those workers who work at night.
The local Malaysian workers also demanded similar points to the factory authorities. The factory authorities replied that they will respond the demands of the workers on 15th December 2008. Since 11th December 2008, many foreign workers are now stopping to work in the factory and staying at their residential places which are provided by the factory.

Concerning the above mentioned cases, the workers contacted Burma Campaign Malaysia (BCM) through Lanthit journal to help them. Mr. Tun Tun and Mr. Yan Naing Tun from BCM went to Pasir Gudang in Johor to collect the facts about the conflict between employers and employees on 13th December 2008. The BCM is now consulting with concerned NGOs, Mr. Tian Chua, MP and information Chief of PKR, also advisor of BCM, Mr. Moe Swe of Ywanchioo workers' association and TENAGANITA NGO for further activities.

Latest Situation of Khin Zaw and His Eight Other Friends

Around 11:20 am, Ko Harun, Khin Zaw and Kyaw Hlaing Win went to TENAGANITA SDN BHD office. Pusenthi P. Manaim, the programme officer discussed with them how to carry on the case. About 3 pm, Mr. Andre Shum, the Managing Director of Vm Capital SDN BHD arrived at TENAGANITA office. On behalf of the owner of Sea House Food industry, Andre Shum complained that Khin Zaw and his friends did the wrong way (it meant that Khin Zaw and friends informing the police). In such kind of case, informing the police is not relevant according to the Malaysian law, said Andre. Andre pointed out, according to the Malaysian law, foreign workers have no right to oppose or boycott their employer and if the workers did, they would be deported back to their origin of country.

The root cause of this problem was that the employer forced the employees to work without unlimited working-hours everyday.

Ms Sani has tried to compromise between workers and Mr. Andre Shum, the representative of the employer. Mr. Andre agreed on the condition, if the workers go back to work, the workers will be paid their two months wages which were previously kept as deposit money by the employer. Mr. Andre Shum said that his boss has been facing with financial difficulties at present and consequently paying wages for the workers had to be delayed. If the workers worked with the spirit of family members themselves, there would not be any problems, said Mr. Andre.

After that, a consensus was reached between Pusenthi P. Manaim and Mr. Andre Shum that next week the factory owner would invite Pusenthi P. Manim and Ko Harun to visit the factory to check the situation of workers in terms of working and living condition.

At present, Khin Zaw and Kyaw Hlaing Win have already returned to the house which is provided by their employer.

During the case of those workers, Ko Huran and Ko Tun Tun provided necessary financial assistance while workers communicating with the NGO.

Khin Zaw and eight others exploited and beaten by employer

Khin Zaw and nine other workers who are currently working at Sweet House Food Industries SDN BHD (620936-K) in Malaysia have been exploited by their employer. All these Burmese workers are holding valid Burmese passports. The following are the names and passport numbers of nine workers.

The Burmese workers said that their employer kept their two months wages as deposit money and they are forced to work from 7 am to 2 or 3 am. If the workers arrive at the factory late in the morning, their wages are cut off. There are no days off no break time for the workers and when the workers are fallen asleep during working time, they are beaten by the employer, according to the workers.

Even though the workers tried to compromise with their employer, the employer turn downed their demands. On 8 November 2008, all nine workers didn't go to work and staying at home which has been provided by the employer. The employer arrived at the home on same day, not only denying the demands of the workers, but physically beating the workers. Then, the employer detained the workers in the house and locked it with the new padlock. Later, all nine workers jumped out from the kitchen window and escaped. As soon as they escaped from illegal detention, they went to the Burmese community and asked Ko Harun for some help.

Ko Harun suggested them to inform the police and Khin Zaw went to the local police station by 1:30 pm and opened the case. (Police official paper for opening the case is attached) By 4:30 pm, police officers accompanied with Khin Zaw went to the house and the police took a photo of the padlock and the padlock was cut and taken by the police as evidence. The police officer also took more photos in the house as records. Later, police officers and Khin Zaw went together to the factory to see the employer. Then Khin Zaw was told to go back home and the employer was taken to the police station for further questioning.

However, Khin Zaw and Kyaw Khine Win didn't go back home which is provided by the employer, because they were afraid of possible retaliation by the employer. On the same day, about 10 pm, the employer and worker in-charge came to the house asking where were Khin Zaw and Kyaw Khine Win. The other workers said that they didn't where they were and then they were beaten by the work in-charge. The work in-charge is a Burmese citizen. The work in-charge questioned the names and addresses of those who helped them to go to the police station. But the workers replied they didn't know anything about them and Aung Win Htut was beaten again.

Since 9 November, Khin Zaw and Kyaw Hlaing Htun have been hiding away from the factory. On 10 November, the workers went to see the NGO called TENAGANITA, which is helping for migrant workers. The TENAGANITA accepted the case (case No. MYN/10.11.08/239), however the responsible person from TENAGANITA explained that their lawyers were not ready to travel to the factory at that moment. However, on coming Wednesday, they said that lawyers from TENAGANITA will be going to see the employer and solve the problems within their capacity under given situation.

ဒုတိယ ကမၻာစစ္ၿပီးခ်ိန္မွာ ဂ်ဴးေတြကို ပါလက္စတိုင္းေဒသတြင္း ျပန္လည္ေနရာခ်ထားမႈက စတင္ၿပီး အေမရိကန္နဲ႕ အဂၤလန္တို႔ရဲ႕ တရားမွ်တမႈမရွိတဲ ဆံုးျဖတ္ခ်က္ေတြကုိ ေထာက္ျပၿပီး မူစလင္ကမၻာကုိ အိုလမာေတြက စည္း႐ံုးခဲ့ၾကတယ္။ ၁၉၅၀ ခန္႕ကစၿပီး အိုလမာေတြရဲ႕ ၾသဇာဟာ တစတစ ႀကီးထြားလာပါေတာ့တယ္။ အဲဒီအခ်ိန္ကစၿပီး သူတို႕ရဲ႕ အာဏာကို ဆန္႕က်င္တဲ့ လႈပ္ရွားမႈ မွန္သမွ်ကို ႏွိမ္ႏွင္းပါေတာ့တယ္။ ဥပမာအားျဖင့္ေျပာရရင္ သူတို႕အရင္ အစၥလာမ္ဘာသာမွာ ၾသဇာ ရွိခဲ့ၾကတဲ့ ဆူဖီ ( သူေတာ္စဥ္ )မ်ားႏွင့္ ထြက္ရပ္ေပါက္ ပုဂၢဳိလ္မ်ားရဲ႕ ဂူဗိမာန္မ်ားကုိ ဘာသာေရး အျပင္မွ လုပ္ရပ္မ်ားအျဖစ္ ေျပာဆိုၿပီး ဖ်က္ဆီးပစ္ခဲ့ၾကတယ္။
ျမန္မာႏိုင္ငံမွာေတာ့ ၁၉၈၈ အာဏာသိမ္းၿပီးခ်ိန္မွာ စစ္အစိုးရက ၿမဳိ႕လည္မွ သုႆာန္ ေနရာမ်ားကုိ ဖယ္ရွားရန္စတင္ခ်ိန္တြင္ အိုလမာမ်ားက ဖ်က္သိမ္းမႈကုိ ေထာက္ခံ ခဲ့ၾကသည္။ အေၾကာင္းကေတာ့ အဲဒီသုႆာန္မ်ားအတြင္း၌ရွိေသာ သူေတာ္စဥ္မ်ားႏွင့္ ထြက္ရပ္ေပါက္ပုဂၢဳိလ္ မ်ား၏ ဂူဗိမာန္မ်ား မရွိမွသာ ၎တို႔၏ ၾသဇာမ်ား ေနာင္အနာဂါတ္တြင္ ပိုမိုလႊမ္းမိုးရန္ ရည္႐ြယ္၍ ယခုလို စစ္အစုိးရအလိုၾက ဘာသာေရးႏွင့္ မကိုက္ညီစြာ ျပဳလုပ္ခဲ့ၾကတယ္။ အစၥလာမ္သာသနာေရးေကာင္စီကမူ ကန္႔ကြက္ခဲ့သည္။ စစ္အစိုးရကလည္း အဲဒီ အခ်ိန္ကစၿပီး သူတို႕ကုိ အသိအမွတ္ ျပဳခဲ့တယ္။ အရင္အခ်ိန္ကအစၥလာမ္ သာသနာေရးေကာင္စီသာလ်င္ ျမန္မာႏိုင္ငံရွိ မူစလင္တို႔ရဲ႕ ကိုယ္စားျပဳအဖြဲ႕အစည္းျဖစ္ရာက ယခုအခ်ိန္မွာေတာ့ ႏွစ္ဖြဲ႕ျဖစ္ေနပါတယ္။
တခ်ဳိ႕ေသာ အိုလမာမ်ားဟာ ဘာသာေရးအာဏာအျပင္ ႏိုင္ငံေရးအာဏာတြင္ပါ သူတို႔၀င္ေရာက္ ခ်ယ္လွယ္ႏိုင္ရန္ ႀကဳိးစားရာမွ မူဂ်ာဟစ္အဖြဲ႕မ်ား ဖြဲ႕ၿပီး စစ္ေရးအရပါ ေဆာင္ရြက္ပါ ေတာ့တယ္။ မူဂ်ဟစ္လႈပ္ရွားမႈမ်ားကို လုပ္ေဆာင္ခ်ိန္တြင္ မေအာင္ျမင္ခဲ့သျဖင့္ ေပ်ာက္ကြယ္လု ျဖစ္ေနခ်ိန္တြင္တကမၻာလံုး၌ ဆက္သြယ္ေရးနည္းပညာမ်ား အလ်င္အျမန္တိုးတက္မႈေၾကာင့္ လူအမ်ားစုသည္ အေနာက္တိုင္းယဥ္ေက်းမႈမ်ား၏ ၾသဇာလႊမ္းမိုးမႈကို ခံေနရၿပီး ဘာသာေရး သြန္သင္ ဆံုးမမႈမ်ားကုိ လိုက္နာမႈ နည္းပါးလာၾကတယ္။ အထူးသျဖင့္ အိမ္တြင္းေျဖာ္ေျဖေရးမ်ားတြင္သာ အခ်ိန္ကုန္ခံၿပီး ဘာသာေရးကုိင္း႐ႈိင္းမႈနည္းပါးလာျခင္း၊ တကုိယ္ေရလြတ္လပ္မႈကုိ ပိုမိုလက္ခံၿပီး အိုလမာမ်ားကိုေရွာင္က်ဥ္လာျခင္းတို႕ကို ဘာသာေရးအရ ေထာက္ျပျခင္း၊ ႏိုင္ငံေရးအားျဖင့္ အစၥလာမ္ ဘာသာ၀င္တုိ႕ရဲ႕ အထြတ္အျမတ္ထားရာ ေနရာမ်ားတည္ရွိေသာ ေဆာ္ဒီအာေရဗ်အပါအ၀င္ အေရွ႕အလယ္ပိုင္းႏိုင္ငံမ်ားတြင္ အေမရိကန္႕ရဲ႕ တပ္မ်ားခ်ထားႏွင့္ စိုးမိုးလာမႈကို ေထာက္ျပျခင္း၊ အေနာက္တိုင္းယဥ္ေက်းမႈဆန္႕က်င္ေရးႏွင့္ ဘာသာေရးသြန္သင္ခ်က္မ်ားကို တိတိက်က် လုိက္နာ ေစရန္ စသည္တို႕ကုိရည္ရြယ္ၿပီး တာလီဘန္အဖြဲ႕ေတြကို အာဖဂန္နစၥတန္နဲ႕ ပါကစၥတန္တို႕မွာ စတင္ ဖြဲ႕စည္းခဲ့ၾကပါတယ္။ ကံအားေလ်ာ္စြာ အာဖဂန္မွာ တာလီဘန္ေတြ အာဏာရသြားေတာ့ ေဆာ္ဒီအာေရးဗ်က အသိအမွတ္ျပဳျခင္းကုိ ၾကည့္ျခင္းအားျဖင့္ မူစလင္ကမၻာမွာ အိုလမာ တာလီဘန္တို႕ကုိ မည္မွ်ေနရာေပးေနၿပီး အေနာက္အုပ္စုကုိ ဆန္႕က်င္ခ်င္တဲ့ဆႏၵ ဘယ္ေလာက္ရွိတယ္ ဆိုတာကို ဤအခ်က္ကုိ ၾကည့္ျခင္းအားျဖင့္ သိႏိုင္ပါတယ္။ ၉/၁၁ ျဖစ္စဥ္ ၿပီးမွသာ အေမရိကန္ရဲ႕ ဖိအားေပးမႈေၾကာင့္ ေဆာ္ဒီအာေရးဗ်က တာလီဘန္အစိုးရကုိ အသိမွတ္ၿပဳမႈ ရပ္ဆဲလိုက္တာပါ။
တာလီဘန္ေတြကို စစ္ေရးအရ အျပတ္ရွင္းေရးလုပ္ငန္းစဥ္ဟာ ဘယ္ေတာ့မွ ေအာင္ျမင္ လာမွာ မဟုတ္ပါဘူး။ ကမၻာ့မူစလင္အမ်ားစုရဲ႕အျမင္မွာ အေမရိကန္ႏွင့္ တျခားအေနာက္အုပ္စု၀င္ ႏိုင္ငံမ်ားသည္ အေရွ႕အလယ္ပိုင္း ျပႆနာကုိ ဘက္လိုက္ၿပီးေဆာင္႐ြက္ေနၾကသည္။ ဒါ့ေၾကာင့္ ပါလက္စတိုင္းတို႕ ဒုကၡေရာက္ေနရသည္ဆိုၿပီး ျမင္ၾကသျဖင့္ သူတို႕အားလံုးသည္ အေမရိကန္ႏွင့္ အေနာက္အုပ္စု ဆန္႕က်င္သူကုိ လူစြမ္းေကာင္းအျဖစ္ လက္ခံၿပီး ေထာက္ခံၾကသည္။ ဒါ့ေၾကာင့္ အစၥလာမ္ႏိုင္ငံေတြမွာ ဘာသာေရးအေျခခံ ႏိုင္ငံေရးအဖြဲ႕အစည္းေတြကုိ လူေတြက အားေပးလာၾက တာပါ။ အဲဒီလူေတြက ေနာင္မွာ သူတို႕ရဲ႕ လြတ္လပ္ခြင့္ေတြကုိ ကန္႕သတ္လာမွသာ ( ရွရီ အက္တရား ဥပေဒႏွင့္ အတင္းအက်ပ္ ထိမ္းခ်ဳပ္လာ ) မေထာက္ခံၾကေတာ့တာပါ။
ရွရီတရားဥပေဒအေၾကာင္းကုိ အနည္းငယ္ရွင္းျပလိုပါသည္။ ဒီကေန႕ ရွရီအက္တရားဥပေဒ ဟု ၾကား႐ံုျဖင့္ အင္မတန္ျပင္းထန္ေသာ ဘာသာေရးဥပေဒအျဖစ္ အားလံုးကျမင္ၾကသည္။ တကယ္ေတာ့ ဤဥပေဒတြင္ ယေန႕ေခတ္ ဥပေဒမ်ားကဲ့သို႔ စီရင္ခ်က္ခ်မွာရာ၌ တရားသူႀကီး၏ ဆီရင္ဆံုးျဖတ္မႈအေပၚတြင္သာ မူတည္သည္။ သို႕ေသာ္လည္း စီရင္ထံုးျဖတ္ခြင့္ရွိေသာ ဘာသာေရး ဆိုင္ရာ ပညာရွင္မ်ားျဖစ္ၾကသူ အိုလမာမ်ားသည္ လုပ္ကုိင္ခြင့္ကုိ အဆံုးစြန္ထိ အသံုးခ်ခဲ့ေသာေၾကာင့္ သာ မူစလင္မဟုတ္ေသာသူမ်ားက ရွရီအက္ဥပေဒကို လက္မခံႏိုင္ျခင္းျဖစ္သည္။ ဥပမာျပရလ်င္ ျမန္မာႏိုင္ငံ၌ မိန္းကေလးငယ္တဦးႏွင့္ အမ်ဳိးသာငယ္တဦးတို႕ ဘာသာေရးအရ တရား၀င္ လက္ထပ္ျခင္းမရွိဘဲ အတူတကြေပါင္းသင္းေနထိုင္ၿပီးမွ ႏွစ္ဘက္ေသာ မိဘမ်ား၏ အစီအစဥ္ျဖင့္ ျပန္လည္၍ ဘာသာေရးအရ တရားသင္လက္ထပ္ရန္ ျပဳလုပ္ေသာအခ်ိန္၌ ဘာသာေရးဆရာ ( ဗလီဆရာ ) ( စကားခ်ပ္။ ။ ထိုသူတို႔သည္ အိုလမာအဖြဲ႕၀င္လည္းျဖစ္ႏိုင္သည္။ ) က အဆိုပါစံုတြဲအား ေမးျမန္းမႈတခု ျပဳလုပ္ပါသည္။ အသင္တို႔ႏွစ္ဦးသည္ ဘာသာေရးအရ တရား၀င္လက္ထပ္ျခင္းမရွိဘဲ အတူတကြေပါင္းသင္းဆက္ဆံမႈရွိခဲ့ပါသလားဟုေမးျမန္းေသာ္ အမွန္အတိုင္း ေျဖဆိုၾကရသည္။ အဲဒီအခ်ိန္၌ ဆက္ဆံမႈရွိခဲ့သည္ဟုေျဖဆိုပါက ဗလီဆရာမွ ျပစ္ဒဏ္ေပးပါသည္။ ဥပေဒအရ ျပစ္ဒဏ္မွာ ေက်ာတရာ၊ ရင္တရာ ႐ိုက္ႏွက္၍ အျပစ္ေပးရမည္။ သို႔ေသာ္လည္း အသံုးျပဳရမည္မွာ ႀကိမ္လံုး၊ ၀ါးျခမ္းျပား၊ က်ဴ႐ိုး၊ ငွက္ေပ်ာ႐ိုးအစရွိသျဖင့္ စီရင္ဆံုးျဖတ္သူအေပၚမူတည္၍ ေရြးခ်ယ္ပိုင္ခြင့္ ရွိရာ မ်ားေသာအားျဖင့္ ငွက္ေပ်ာ႐ိုးကဲ့သို႕ေသာ ခံႏိုင္ရည္ရွိသည့္အရာကုိသာ ေရြးခ်ယ္ အသံုးျပဳသျဖင့္ ျပစ္ဒဏ္ခံရသူအတြက္ ျပႆနာမရွိေပ။ သို႕ေသာ္လည္း တျခားမူစလင္ႏိုင္ငံမ်ား၌မူ ႀကီးေလးေသာ ျပစ္ဒဏ္မ်ားကိုသာ အသံုးျပဳၾကသည္။
ဤေနရာတြင္ အခန္႕သင့္၍ဗလီဆရာမ်ားႏွင့္ပက္သတ္ၿပီး ရွင္းျပခ်င္ပါသည္။ ျမန္မာႏိုင္ငံတြင္ ဗလီဆရာမ်ားကို အစၥလာမ္ဘုန္းႀကီးဟု တျခားဘာသာ၀င္မ်ားက လြယ္ကူစြာ ေခၚေျပာေနမႈမွာ မွားယြင္းေနပါတယ္။ အမွန္မွာ အစၥလာမ္ဘာသာတြင္ ဘုန္းႀကီးမရွိပါ။ သူတို႕အားလံုးသည္ ဘာသာေရး စာေပကိုကၽြမ္းက်င္နားလည္ၿပီး ၀တ္ျပဳရာတြင္ ေရွ႕ေဆာင္ ေရွ႕ရြက္ ျပဳရသူမ်ားသာလ်င္ ျဖစ္သည္။
အခ်ဳပ္အားျဖင့္ေျပာရလ်င္ အစၥလာမ္ဘာသာသည္ တင္းမာျပင္းထန္ေသာ ဘာသာတရား မဟုတ္ပါ။ လူ႕ပါတ္၀န္းက်င္ႏွင့္ လိုက္ေလ်ာညီေထြစြာ ေနထိုင္ႏိုင္ေသာ ဘာသာတရားျဖစ္ေသာ္လည္း လက္ရွိအခ်ိန္၌ ဘာသာေရးအရ အာဏာရွိၾကေသာ ဘာသာေရးပညာရွင္မ်ား ( အိုလမာ၊ တာလီဘန္) ေၾကာင့္သာ ယေန႕ကမၻာတြင္ ေၾကာက္စရာဘာသာေရးအျဖစ္ အျမင္ခံေနရျခင္းျဖစ္သည္။ အိုလမာ၊ တာလီဘန္မ်ားကုိ အန္တုႏိုင္ေသာ ဘာသာေရးပညာရွင္မ်ား ေနရာမရသ၍ ဤျပႆနာမ်ားကုိ ကမၻာႏွင့္အ၀ွမ္း ရင္ဆိုင္ေနၾကရဦးမည္ကုိ ေတြးရင္း စိတ္မေကာင္းျဖစ္မိပါသည္။
